This Privacy Policy (hereafter “Policy”) explains our approach towards personal data, the information we collect about you, the reasons why we collect such data and the way we might use it. This Policy applies only to your use of the heartbrowser.com search engine (hereafter “Services”). This Policy does not apply to any third-party website or service linked to the Services or to any other website, product, or service operated by our company, or to any of our offline activities. By use of the Services, you agree to the collection and use of information described in this Policy as well as our terms of use.

How do we define personal data?

We use a broad definition of personal data which is based on the privacy laws and regulations of the EU, including the EU General Data Protection Regulation (GDPR). These are widely regarded as the strongest privacy protections in the world. We consider any information about you or your behavior that can be traced back to you as personal data.

When do we collect personal data, and why?

Heart does not require any registration to use its Services.

Heart collects connection data and anonymous statistics with respect to product usage, not associated with your search queries, to ensure the security of its information system and to have basic metrics regarding the product usage.

Who is our subprocessor?

Subprocessor: Microsoft Corporation or an affiliate thereof (collectively, “Microsoft”)

Purpose of the processing: Provision of search results

When the Services require Microsoft to transmit results that match the entered keywords, the Services anonymizes the required data and therefore only transmits to Microsoft the entered keywords. An approximate geographic area of the origin of the search query, to the scale of a region or a city, is sent to deliver ads that are more locally relevant (for instance if you search for an electrician).

Retention period: This anonymized data may be retained by Microsoft in accordance with Microsoft’s privacy policy.

Data transfer outside the EU: While receiving search results implies that we send our subprocessors the query terms, the query terms we send the subprocessors are not associated to any personal information, making this process a transient exchange.

For connection data, we do not collect directly identifying information (we do not store your IP address). The information we process for user queries are a hashed IP address and approximate geolocation.

Likewise, since Heart is committed to respecting your privacy, by default, cookies are not used or set in your browser. However, if you chose to change a search setting or preference, such as opening links in the search page, we will store that in the local storage as openInNewTab = false, with no identifier or tracking information.

What are your rights and how can you exercise them?

Data protection regulation grants you with specific rights related to your data and the processing of that data by Heart as detailed below:

  • right to access, rectify, delete data under the conditions set forth by the regulation (articles 15-17 of the GDPR);
  • right to oppose the processing under the conditions set forth by the regulation (art. 21 of the GDRP);
  • right to limit the processing of personal data under the conditions set forth by the regulation (article 18 of the GDPR);
  • right to data portability (article 20 of the GDPR); and
  • right to make a claim before a control authority (article 13 of the GDPR)

Right to access

You can ask us if we have any information related to you and ask us about the processing of such information (for instance, the categories of data we process). This right allows you to ask Heart to give you all such information. Information related to this right to access (such as your contact info) are kept one year after Heart has answered your query, then deleted immediately thereafter.

Right to rectify or suppress

For forms for delisting requests and other rights exercising requests, you can ask to rectify data by sending an electronic request to [email protected].

Right to erasure

This right allows you to have to data erased as soon as possible by sending an electronic request to [email protected]. Information associated to the exercise of the right to erasure are stored for one year from the day Heart answers, then deleted immediately thereafter.

Changes to this policy

We may change this Policy at any time by posting a new version on this page or on a successor page. The new version will become effective on the date it is posted, which will be listed at the top of the page as the new Effective Date.
